The Aussie rocker was over the moon as he and Paula Yates showed Heavenly Heraani Tigerlily to the world for the first time. The proud parents were thrilled to pose with Tigerlily, who was born in the bathtub - and according to Paula's account (see the column special), right next to the laundry basket - in their London home a fortnight ago. Michael helped deliver Tigerlily during the two-hour labour, describing it as the most amazing experience of his life. Paula beamed as Michael posed with the baby, who weighed in at 3.1kg (6lb 14oz). "Watching Michael with our daughter is just fantastic," she says. "He's a natural father, as I knew he would be. Tigerlily is a very licky girl." The couple chose the name Heavenly "because she will be" and picked Heraani, meaning princess of the Beautiful Sky, because it is Michael's favourite Polynesian word - although they still dont seem to have decided which name to use on a day to day basis. Michael, 34, was overjoyed to show off his first child. "Every time I look at her I start beaming. She is beautiful. I still cant believe I am a Dad," He says. A former party animal, Michael has already shown how much he loves being a father by spending most of his spare time with Paula's other daughters from her marriage with Bob Geldof - Fifi Trixibelle, 13, Peaches, 6, and Pixie, 5. The children adore their new sister. "Peaches has been halping change her nappies and telling everyone just how good she is with children," says her proud mum. Although Paula, 36, wants to show everyone her new daughter, Michael is keen to guard his family's privacy. When Paula took the week-old baby on her first outing, the INXS lead singer - now fuelled by protective instincts - once again lost his temper with photographers. Michael stayed in the cab while Paula, Tigerlily and Peaches visited a building society and a bookshop. Then, without warning, Michael jumped out and pushed one of the photographers. But although he takes a firm line with the press, Micjael is a real softie when it comes to kids. "Ive found out I'm a pretty good dad ... and a soft touch," he said in an Australian radio interview shortly before the birth. Michael hasn't yet said when he plans to bring his new daughter back to Australia to meet the folks. He had been away from Australia for three years when he took Paula home for a family christmas last year. "I forgot how fantastic it was," said Michael, adding he'd like to spend more time here. But he'll definitely have to wait a while before Tigerlily is old enough to be introduced to her dad's favourite Aussie snack - Violet Crumbles. ==================================================================== Column Special For the birth at home of Heavenly Heraani Tigerlily, I had two marvellous midwives, Caroline and Val, plus Michael, of course. It was Caroline who, the day before the baby was born, took it upon herself to explain that the home birth was not like any other - it was hot, sweaty and passionate. But, once I realised the baby was on its way, I actually became so prim and polite, I could have been mistaken for the Queen Mother. I didn't want to even call the midwives until six in the morning in case it was a false alarm. By the time we were all in my very small bedroom, I had obviously been taken over by the ghost of Noel Coward, I was so polite and well-behaved. "We get a lot of mums who swear," said Val, as I asked her if she could 'possibly pass the orange juice'. In the event, the entire birth was quite incredibly fast and relatively painless. Tigerlily was born by 8:30am, near the laundry basket, and it made me realise that nothing can compare to a really happy home birth where you are allowed to do exactly as you please during the labour. Even being frightfully polite! I don't know if the band actually has a patent or copywrite on the name (like MacDonalds who would sue any little peon company if they even remotely call themselves anything close to their name). That would be a good one to let the band know about for sure. As an irony (and maybe there's someone that can help me with this).... as most of you know, I have the internet domain name/address for INXS for their official "fanclub" (if it ever gets off the ground!!) and I keep getting emails for various people, addressed to who don't have anything to do with me or the band. I can only copy back to them and ask them to let me know why this is happening and no one has done that yet. It's a real pain to have to respond and deal with these messages. I guess there's an ISP with a similar domain name and people aren't copying it correctly into their databases. Any suggestions about what I can do? Go with the Not Enough Time Maxi as I've recommended, and see if that doesn't change your mind. I would also suggest you check out "Keep the Peace" from the BHCIII movie soundtrack, or Michael's excellent rendition of "The Passenger" from Batman Forever. The logo can be trademarked but the name can't be copyrighted. It would be like saying I want to copyright the name Jane Doe and then no one could ever use it. The majority of copyright cases don't come into play until the party feels that the use of the name is being taken advantage of in a financial way, for someone else's benefit. I believe that they have to sue for an injunction (can't remember the exact legal term right now) to halt the other band or whatever from using the name to take away business from the other more well-known band, etc. It can often be futile on the part of the trademark holder though. Aspirin used to be a trademark name. Companies like Kleenex and Xerox are fighting this now with the use of heavy advertising so that people are aware that facial tissues aren't all Kleenex, etc. But they are trademarks and not copyrights. I don't know if that helped at all. It's a very complex legal issue and isn't easily explained. And, of course, my 4 law classes haven't made me a lawyer by far. But that was what I've learned in my media law class last year. My father is an intellectual property attorney who does a lot of work with band names. This is his professional opinion: A band name is a Service Mark for entertainment services. These services are considered to be live music. Action may be taken against any live music provider using a name that has been registered (or has been in use long enough to be recognizable). This year, Clinton signed a new law called the Anti-Dilution Statute. This statute states that a holder of a famous mark can stop others from using the mark even for unrelated services. This is because there is so much merchandising done with famous marks that it is entirely possible that, for example, a band would want to market a cologne. So, at least in the US, INXS could go after anyone using the name for anything. Legal action is up to the band - they may not think it's worth the trouble to sue a speedboat team. Band names are registered and protected regularly as Service Marks - my dad has done this for artists like The Police, Billy Joel, Hall & Oates, The Village People, etc. Much of the legal action is taken against the manufacturers of counterfeit merchandise (the cheap and ugly t-shirts sold outside the concerts). As for intellectual property terms, here's a quick explanation: A copyright applies to a creative work, like a book or a music recording. A patent applies to an invention, like a camera or a medicine. A trademark applies to the name of a product, like Coca-Cola or Kleenex. All of these may be registered and protected. The assistant in Sanity Records tells me it's no longer in production, I didn't know what else to think. I don't own a Laser disk player either. I feel there is nothing wrong with even trading (I have a tape of bsides that I'll exchange with your tape of bsides). I also feel there is nothing wrong with paying money for a tape/cd that is no longer offered by the record company. If it's not offered by the record company then the band is not being ripped off. The band got their money on the original purchase. I do have a problem with someone making cds and selling them, espcially if some of the bsides are readily available. There was a release about INXS when the band was signed to Mercury. As I've said before (here I go again), a press release now would get lost and forgotten long before the album came out. It's just not worth it. Magazines and stores are using their space for albums that will be out for the holiday gift season. This business works in quarters and the fourth quarter is a biggie. Of those that come to mind, the tour with The House Of Love. As a huge fan of them it was hard to think they were supporting us on some shows. INXS coming on to play one of their songs with us. We started playing "This Time" by them and I could see Michael Hutchence at the side waiting to come on and I just thought how bizarre it all was. But also the early days, especially our first show when we realised that we had 'something'. And then our first LA show at The Whiskey A Go Go which sold out on the basis of KROQ playing Black Metallic.
